ERF – Environmental Regulatory Fee

For over 50 years, Modern remains dedicated to providing the highest quality of service at a reasonable cost and are dedicated to keeping our environment safe. Unfortunately and due to the escalating cost of environmental and regulatory compliance, which has a tremendous impact on our industry, we are forced to implement an Environmental Regulatory Fee.
The Environmental Regulatory Fee 11% of your total service charge before tax.
The Environmental Regulatory Fee or ERF will cover costs related to meeting the high standard of environmental and regulatory compliance set by internal management and external governmental regulatory factors at the Local, State and Federal level.
These factors include but are not limited to host community fees, waste disposal taxes and similar charges that we pay to municipal or other governmental authorities or agencies to engage in the waste collection transfer, processing, disposal, incineration, treatment and/or recycling business and to achieve an acceptable operating margin.
Unlike the Fuel Surcharge, Environmental Regulatory Fee does not fluctuate monthly and is currently set at 11% of your invoice charge, excluding tax. Like the Fuel Surcharge, the Environmental Regulatory Fee is not related to the specific costs of servicing your account, but on the costs incurred on all aspects of our operations.
The Environmental Regulatory Fee is not a tax or surcharge mandated or imposed by or remitted to any Local, State or Federal governmental agency. As noted above, the fee helps to recover our costs to achieve an acceptable operating margin.
In addition to our Fuel Recovery Fee, the Environmental Regulatory Fee may be changed at the discretion of Modern. Your service agreement may require your consent to these fees; under such service agreements however, your payment of these fees provides your consent.

Q: Is the environmental regulatory fee a Governmental Tax
A: No, the environmental regulatory fee is not a tax or surcharge mandated or imposed by or remitted to any governmental or regulatory agency. It is a fee charged to recover our companies’ costs as the result of fees and expenses we pay which are imposed by governmental agencies regulating our industry and achieve an acceptable operating margin.
Q: Why am I charged environmental regulatory fee?
A: The environmental regulatory fee is our charge to cover a portion of our company-wide costs associated with host community fees, waste disposal taxes and similar charges that we pay to municipal or other governmental authorities or agencies to engage in the waste collection, transfer, processing, disposal and recycling business.

Q: How often does the environmental regulatory fee change?
A: We periodically review the fees to determine whether they are appropriately recovering costs and contributing to an acceptable operating margin. We may adjust the fee annually if necessary. If there were to the fee, you would be notified through your billing statement. Your service agreement may require your consent to these fees; under such service agreements, your payment of the fees provides your consent.

Q: What does the environmental regulatory fee cover?
A: The environmental regulatory fee is a fee that we attribute to our overall company-wide costs to operate our business in a safe and environmentally responsible manner and to achieve an acceptable operating margin. This environmental regulatory fee is not specifically tied to the environmental compliance or other costs to service each individual customer account, but to overall environmentally related costs to service all customers and to achieve an acceptable margin. Our environmentally related costs include, among other things, engineered host community agreement, engineering services, testing, compliance and maintenance in our landfills.

Q: Will the environmental regulatory fee change each month?
A: No. The environmental regulatory fee will not fluctuate each month. It is currently set at 11% of all invoice charges, including the fuel surcharge (but excluding taxes). The percentage may be changed periodically if there is a business determination that warrants a change in the charge.

Q: What is a “host community fee”?
A: A “host community fee” is a charge Modern pays, by the ton on a quarterly basis to the Town of Lewiston to locate, construct and operate our waste facility.

Q: I do not live in the community with a host fees or disposal taxes, why am I being assessed the environmental regulatory fee?

A: Because this is a company-wide charge, this charge is applied to a customer’s invoice whether or not the customer is located the community which has the host community fee.
